Sức mạnh vô hình của những giá trị Mỹ chuyển động, 61 Sếp Cảnh Sát của nước Mỹ ký Bản Tuyên Bố gửi các nghị sỹ Quốc Hội phản đối yêu cầu của tổng thống Trump muốn cảnh sát bố ráp dân nhập cư lậu.
Câu chữ hành chính hơi khó hiểu nhưng nội dung là các Sếp Cảnh Sát không muốn hợp tác thực thi việc bố ráp người nhập cư mà muốn việc đó để cho nhân viên di trú liên bang thực hiện! Rằng việc đó không tốt cho cộng đồng vì nó gieo rắc sự sợ hãi và không khắc phục được những khiếm khuyết của hệ thống di trú Mỹ…
Thưa Thượng nghị sĩ:
Là những người lãnh đạo thực thi pháp luật, nhiệm vụ chính của chúng tôi là phục vụ và bảo vệ các thành phố, quận và thị trấn của chúng ta. Về mặt này, chúng tôi cam kết hướng tới an toàn công cộng – bảo vệ sự an toàn của cộng đồng chúng ta và duy trì các quy định của pháp luật.
Thi hành di trú trước hết là trách nhiệm của liên bang. Chúng tôi tin rằng làm cho cộng đồng của chúng ta an toàn hơn có nghĩa là xác định tốt hơn các vai trò và cải thiện mối quan hệ giữa cơ quan thực thi pháp luật địa phương và cơ quan di trú liên bang. Kiểm soát địa phương đã là cách tiếp cận có lợi cho việc thực thi pháp luật trong nhiều thập kỷ – Đề xuất chính phủ liên bang bắt buộc cơ quan thi hành luật ở tiểu bang và địa phương thực hiện các công việc mới và đôi khi tạo ra vấn đề làm suy yếu sự cân bằng tinh tế của bang và sẽ gây tổn hại cho cấp cơ sở trong việc thực thi chính sách theo định hướng cộng đồng.
Chuyên môn và nguồn lực có giá trị của các sĩ quan và nhiệm vụ của chúng ta nên ưu tiên vào các mối đe dọa như các tội phạm nguy hiểm và các tổ chức tội phạm đang gây hại. Chúng tôi tin rằng cơ quan hành pháp nhà nước và địa phương phải làm việc cùng với các cơ quan liên bang để bảo vệ cộng đồng của chúng ta và chúng tôi có thể phục vụ tốt nhất các cộng đồng của chúng ta bằng cách để việc thực hiện luật di trú cho chính phủ liên bang đảm đương. Xu hướng cắt ngân sách có giá trị từ các cơ quan có thẩm quyền không cấp cho tiểu bang nữa, quyết định không sử dụng các nguồn lực đã hạn chế của chúng ta để thực thi luật di trú của liên bang là cực kỳ có vấn đề. Loại bỏ ngân sách được cấp cho các cộng đồng đang lành mạnh và đang tồn tại tốt trên toàn quốc sẽ không làm cho cộng đồng của chúng ta an toàn hơn và sẽ không khắc phục được bất cứ phần nào của hệ thống di trú đang có khiếm khuyết của chúng ta.
Vấn đề của cái gọi là “thẩm quyền bảo hộ người nhập cư” là một vấn đề phức tạp. Không có một định nghĩa có thể ước lượng được về những gì bao gồm một “thẩm quyền bảo hộ người nhập cư” và thuật ngữ này thường được định nghĩa quá rộng. Thuật ngữ này thường được áp dụng trong nhiều địa phương mà lâu nay đã được quản trị rất tốt hoặc theo các quyết định của tòa liên bang đã tìm thấy các tù nhân di trú liên bang vi phạm hiến pháp.
As law enforcement leaders, our primary mission is to serve and protect our cities, counties and towns. In this respect, we are committed to a path to public safety – preserving the security of our communities and upholding the rule of law.
Immigration enforcement is, first and foremost, a federal responsibility. We believe that making our communities safer means better defining roles and improving relationships between local law enforcement and federal immigration authorities. Local control has been a beneficial approach for law enforcement for decades – having the federal government compel state and local law enforcement to carry out new and sometimes problematic tasks undermines the delicate federal balance and will harm locally-based, community-oriented policing.
The valuable expertise and resources of our officers and deputies should prioritize threats such as dangerous criminals and criminal organizations causing harm. We believe that state and local law enforcement must work together with federal authorities to protect our communities and that we can best serve our communities by leaving the enforcement of immigration laws to the federal government. Threatening the removal of valuable grant funding from jurisdictions that choose not to spend limited resources enforcing federal immigration law is extremely problematic. Removing these funds that contribute to the health and well-being of communities across the nation would not make our communities safer and would not fix any part of our broken immigration system.
The issue of so-called sanctuary jurisdictions is a complex one. There is no set definition of what comprises a “sanctuary jurisdiction” and the term is often defined much too broadly. The term often sweeps in localities that engage in well-established community policing practices or follow federal court decisions that have found federal immigration detainers violate the constitution.
We are concerned that many jurisdictions that cooperate with federal immigration authorities and are in compliance with federal law, including the information-sharing requirements of 8 U.S.C. § 1373, could find themselves facing penalties under various proposals under discussion, including the loss of important federal funding. We urge this Committee to be mindful of the current state of the law and the needs of local law enforcement while considering a legislative response that will ensure a path to public safety is achieved.
Our immigration problem is a national problem deserving of a national approach, and we urge Congress to lead the way in working towards taking the necessary steps to fix our broken system through a permanent legislative solution. In so doing, we hope that this
Committee will avoid taking actions that could harm community trust and make it harder
for state and local law enforcement agencies to do our jobs.
